Terms and Conditions

1. ORDER CONFIRMATIONS

Quotes will not be converted to Order Confirmations without a credit card on file and a signed copy of the Terms & Conditions (unless otherwise specified in the Special Instructions on the quote). Items are reserved, and the order is confirmed only after the quote becomes an Order Confirmation. All subsequent order revisions are considered confirmed once the Terms & Conditions are signed.

2. CREDIT CARD AUTHORIZATION

By signing the Terms & Conditions, the Customer authorizes BellEvent Rentals to charge the provided credit/debit card for any outstanding order balances or fees for missing equipment. Card information may be collected verbally, in person, or electronically and may be stored for future transactions on the Customer’s account.

3. CANCELLATION/SUBTRACTION/SUBSTITUTION POLICY

After a quote becomes an Order Confirmation, cancellations, subtractions, or substitutions for tents, tent accessories, and linens must be made at least 14 days before the delivery or customer pick-up date. For all other items, such changes must be made at least 7 days prior. Changes made after these deadlines may incur a restocking fee of up to 100%.

4. RESTOCKING

The Customer acknowledges that orders are prepared in advance of the delivery or pick-up date. Cancellations, subtractions, or substitutions made after the specified deadlines will incur a restocking fee of up to 100%.

5. DELIVERY/PICK UP

Delivery is made to the nearest accessible point for our delivery truck. Deliveries involving stairs, elevators, or locations more than 50 feet from truck parking or on non-cartable surfaces may incur additional fees. Setup and teardown of tables and chairs are not included unless specified in the order. To arrange these services, please contact us several days before delivery for a quote. If arrangements are not made in advance, our driver will need authorization to provide these services upon delivery, and we will accommodate if time permits. For pick-up, equipment should be disassembled and placed at the delivery site; failure to do so may result in additional labor or rescheduling charges

Please Note: Chairs and/or tables are to be restacked on carts as received upon delivery. Customer is responsible for storing carts during the event.

6. CLEANING

China, glassware, and flatware must be returned rinsed, free of food, and properly repacked in the provided containers to avoid additional charges. Excessive food or liquid on returned items will result in a cleaning fee of $45 per hour, as determined by BellEvent Rentals. Special cleaning deposits may apply to BBQ grills and cooking equipment.

7. LINENS

Table linens are inspected prior to release to the Customer and upon receipt from the Customer. If there is obvious damage such as mildew, excessive stains, burns, or tears, the Customer will be charged the replacement cost of the linen. Customers must return all linens dry and free of waste. Linens are to be placed in linen bags provided. DO NOT roll up or store wet linens in any bag, as this will cause mildew.

8. LOSS, SHORTAGES, DIRTY, OR DAMAGED EQUIPMENT

The customer agrees to pay for any damages to rented equipment, excluding reasonable wear and tear, regardless of cause. Customer also agrees to pay a reasonable cleaning charge for all equipment returned dirty. Accrued rental charges cannot be applied against the purchase or cost of repair of damaged goods. Rental Equipment damaged beyond repair will be paid for by the Customer at its Replacement Cost when rented.

9. RESERVATION POLICY

A 50% non-refundable deposit is required at the time of reservation to secure items. The full payment is charged one business day prior to delivery and/or Customer pick-up.

10. PERMITS AND LICENSES

Customers shall, at their own expense and prior to the installation of the equipment, provide all necessary permits, licenses, and other consents unless BellEvent Rentals has included charges on the confirmed order to provide any necessary permits.

11. TENT MATERIAL

All tents are subject to stretching and retracting of up to 5% of listed sizes, and although all tents have been saturated with a waterproofing compound, no tents are guaranteed to be completely waterproof and are to be considered temporary shade structures.

12. WEATHER RELATED RISKS

The customer assumes all weather-related risks associated with holding an outdoor tented event. BellEvent Rentals will endeavor to minimize said risk; however, should the tenting become unusable due to high wind, snow, rain, flooding, extreme cold or heat, or any other factor beyond BellEvent Rentals’ control, the Customer shall still be liable for payment in full of all charges.

13. UNDERGROUND UTILITIES

Customer agrees to have all underground utilities in the vicinity of the tent/equipment installation clearly marked prior to the arrival of BellEvent Rentals work crews. Customer assumes full responsibility for damage to all underground utilities, i.e., underground watering systems, water lines, etc.

14. COOKING/HEATING SOURCES UNDER TENTS

The customer agrees to avoid cooking or using heating sources under or near the tent. Customer assumes full responsibility and costs incurred for damage and or cleaning expenses due to cooking or heating processes under or near tents. PATIO HEATERS ARE NOT PERMITTED FOR USE UNDER OR NEAR TENTS.

15. HARDWOOD FLOORS/SURFACES

BellEvent Rentals will not be held responsible for any damage which may occur due to the placement of rental equipment on any surface including but not limited to hardwood floors, outdoor decks, concrete pads, sport courts, etc.

16. PREPARATION OF SITE

Customer agrees to have the site upon which the equipment is to be erected, free and clear of all obstacles, natural and man-made, prior to the arrival of BellEvent Rentals work crew. Customer further agrees to have all tent areas cleared for removal prior to our arrival. All non-rented equipment and decorations shall be cleared and taken from the site. If Customer fails to do so, then Customer shall pay a wait time charge if driver & crew spend more than 15 minutes waiting to unload/load equipment. Wait time is $15 for every 15-minute period thereafter per crew member.

17. ELECTRIC POWER AND LIGHTING

Customer agrees to furnish BellEvent Rentals access to, and the right to use Customer’s electrical and power source for the installation and operation of the rented equipment.

18. INSPECTION

Customer acknowledges their responsibility to inspect the equipment prior to its use and to notify BellEvent Rentals of any defects or discrepancies. If BellEvent Rentals is notified of damaged equipment or shortages prior to return of items, BellEvent Rentals will inspect the equipment to verify items were unusable or unreceived. Refunds are based upon the inspection and are not guaranteed. If items are found to be in good and working order, no refund will be credited to the Customer.

19. REPLACEMENT OF MALFUNCTIONING EQUIPMENT

If equipment becomes unsafe and/or in disrepair for any reason, the Customer agrees to discontinue its use and notify BellEvent Rentals immediately. BellEvent Rentals will repair or replace the equipment with similar equipment in good working order if available, and if the defect is the result of normal use. BellEvent Rentals is not responsible for any incidental or consequential damages caused by delays or otherwise, and Customer hereby waives any right or entitlement thereto. If BellEvent Rentals replaces the equipment and upon testing the original equipment, discovers that the equipment is in good working order, additional charges may occur for delivery of replacement equipment.

20. RETURN OF EQUIPMENT

At the termination of this agreement, Customer shall return all the equipment to BellEvent Rentals’ premises during BellEvent Rentals’ posted business hours, in the condition and repair as when delivered to Customer, subject only to reasonable wear and tear. The customer must return all equipment to BellEvent Rentals during posted business hours. If BellEvent Rentals has agreed to deliver the equipment to the Customer or to pick up the equipment from Customer, Customer shall be responsible for all losses or damage to the equipment from the time of delivery to Customer and until picked up by BellEvent Rentals. Time is of the essence in this agreement. Any extension must, at BellEvent Rentals’ election, be mutually agreed upon in writing.

21. INSPECTION BY BELLEVENT RENTALS

BellEvent Rentals shall at all times have the right to enter any premises where the equipment may be located for purposes of inspecting it, observing its use, or removing it from Customer’s premise.

22. TITLE AND OWNERSHIP

The rented equipment shall at all times be and remain the sole and exclusive property of BellEvent Rentals. Customers shall have only the rights to use the equipment in accordance with the terms of this agreement. BellEvent Rentals shall have the right to display notice of its ownership of the equipment by display of an identifying stencil, plate, or other marking, and Customer agrees that it will not remove or cover such markings without the written permission of BellEvent Rentals. It is expressly intended and agreed that the equipment shall be personal property even though it may be affixed or attached to real estate. The equipment shall not be removed from the place of delivery or installation without the expressed written permission of BellEvent Rentals.

23. WARRANTIES

BellEvent Rentals is neither the manufacturer of the rented property nor the agent of the manufacturer, and no warranty against patent or latent defects in material workmanship or capacity is given, and Customer expressly waives all such warranties of fitness which may be accorded by law or otherwise. There are no warranties of merchantability or fitness, either express or implied. There is no warranty that the equipment is suited for the Customer’s intended use or that it is free from defects, and any and all such warranties of fitness or otherwise are expressly and specifically waived by the Customer.

24. HOLD HARMLESS AGREEMENT

Customer shall defend, indemnify, and hold harmless BellEvent Rentals, its employees, agents, and subsidiaries, from and against all claims, liabilities, losses, damages to property or otherwise, and expenses, of every character whatsoever, resulting from the actions, negligence, or otherwise, of Customer, Customer’s employees and agents of Customer, or Customer’s subcontractor. The indemnities included in this exhibit shall include reasonable attorney fees paid by BellEvent Rentals in defending suits and actions involving liability covered by the indemnification provision in this paragraph.

25. ASSIGNMENTS, SUBRENTAL, AND LOANS OF EQUIPMENT

Customer may not assign its rights under this contract without BellEvent Rentals’ consent but will remain bound by all obligations herein. The Customer may not sub-rent or loan the equipment without BellEvent Rentals’ written permission. Any purported assignment by the Customer is void.

26. COMPLIANCE WITH LAW AND SAFETY REGULATIONS

As BellEvent Rentals has no control over the use of rented equipment by Customer, Customer agrees at its sole expense to comply with all municipal, county, state, and federal laws, ordinances, and regulations, including the Occupational Safety & Health Administration Act of 1970, which may affect the equipment while it is in the possession of and use by the Customer. Customer shall not permit any person who is not legally qualified to use the equipment.

27. STOLEN PROPERTY

The Customer agrees to pay for rental equipment at its Replacement Cost after all types of theft or disappearance. If the rented equipment is not returned to BellEvent Rentals within two days of the date specified on the face of this contract, such equipment shall be considered stolen. In such an event, Customer may be prosecuted in accordance with RCW 9.45.062 and/or 9A-56-030-050, or in accordance with any other Washington Criminal Laws that may apply.

28. COLLECTION COSTS

The Customer agrees to pay all reasonable collection, attorney, and court fees and other expenses involved in the collection of charges or enforcement of BellEvent Rentals’ rights under this contract.

29. DAMAGE WAIVER TERMS

Each rental contract offers a damage waiver for an additional charge to cover the Customer’s responsibility for the damage to the merchandise caused in the course of normal use. The Damage Waiver does not cover the repair or replacement costs of items that are misused, mishandled, or otherwise abused (example: a chair breaks when being used as a step-stool). Damage Waiver is 10% of the total rental and covers reasonable, accidental damage to the equipment incurred with normal use. It is optional and is non-refundable. If the damage waiver is declined and any rental items are damaged, the customer will be responsible for the replacement charges for the damaged items.

Replacement charges will be assessed on any equipment due to loss, theft, abuse, or intentional damage by the customer. Responsibility for equipment remains with the customer from delivery until return. Please be sure equipment is secured when not in use and is protected from weather and irrigation/sprinkler equipment. Broken equipment must be returned in order for the Damage Waiver to apply.

30. RESTROOM TRAILERS

USE AND MAINTENANCE

The Customer is responsible for the proper use and maintenance of the restroom trailer during the rental period.
The restroom trailer must be used only for its intended purpose and must not be modified or altered in any way.
The Customer must ensure that the restroom trailer is connected to a suitable power source and water supply if required.

CLEANING

The Customer is responsible for ensuring the restroom trailer is returned in a clean and sanitary condition.
A cleaning fee will be assessed if the restroom trailer is returned dirty or in an unsanitary condition.

DAMAGE AND REPAIRS

The Customer is liable for any damage to the restroom trailer beyond normal wear and tear.
Any repairs required due to damage caused by the Customer will be billed at the cost of parts and labor.

RETURN CONDITIONS

The restroom trailer must be emptied of all waste before being returned. A fee will be charged if the trailer is returned with waste.
All fixtures, fittings, and accessories must be intact and in working order upon return.

DELIVERY AND SETUP

BellEvent Rentals will deliver and set up the restroom trailer at the Customer’s specified location.
The Customer must provide clear access and a suitable location for the trailer setup.
Any additional labor required for difficult access or special setup conditions will incur additional charges.

INSPECTION

The Customer must inspect the restroom trailer upon delivery and notify BellEvent Rentals of any issues immediately.
Failure to notify of any defects or issues within 24 hours will be deemed acceptance of the trailer’s condition.

31. MISCELLANEOUS

The Rental Agreement may be executed or delivered by fax or email. The Rental Agreement is valid whether signed by the Customer or not, as long as the Customer takes possession of the rental items. It is also valid if signed by another party on behalf of the Customer, with the signing party indicating ‘C/O’ (Care Of) the Customer.

32. UNSAFE CONDITIONS

BellEvent Rentals reserves the right to refuse installation or delivery of rental equipment due to unsafe conditions or weather. If this occurs, the Customer will be liable for a minimum of 50% of the total cost specified in the Rental Agreement. BellEvent Rentals will use all appropriate means and methods to secure the rental equipment for the safety of the Customer and the equipment.

BellEvent Rentals is not responsible for underground utilities and charges for time out, whether equipment is used or not. The Customer is responsible for checking for underground utilities and water mains if permission is granted to stake anything into the ground.

33. LOCAL RULES AND REGULATIONS

Any rules and regulations governing an event site must be provided in writing to BellEvent Rentals prior to the delivery of rental equipment. Fines incurred due to non-disclosure of such regulations are the Customer’s responsibility.
